1) Lump Sum Contracts
Generally SRJ Contracts are Lump Sum which means the contract sum is based on the requirements of the specs and the drawings
The Drawings and specs are to be complied with (the BQ’s are just a tool for use in calculating monthly progress payments and for unit rates to be applied to variations)
The contractor has to install what is shown on the spec and drawings for the price in the BQ.
If there are discrepancies between Drawings / Specs and BQ (quantities or descriptions) there is no adjustment to the Contract sum (plus or minus)
That said if there are changes between the “Contract drawings” and the ”For Construction Drawings” only the differences between the two sets are measured and valued using appropriate BQ unit rates
The VO issuing the “for construction” drawings is the only VO that needs to be issued
2) Provisional Quantities within Lump Sum Contracts
In the case of SRJ the following sections are noted in the LOA as Provisional Quantities
a) Plumbing pipework and fittings
b) ACV pipework and fittings
c) ACV ductwork and fittings
These provisional quantities are to be re-measured jointly between LSI, GRU and Ssangyong using the Beca “for construction” drawings and the standard method of measurement bound into the contract
The actual types of pipe / duct and fittings will be measured and the appropriate unit rate in the BQ will be applied to the agreed quantities
The Provisional quantities in the BQ will be deleted
The only VO that needs to be issued is the one covering the issue of the “for construction” drawings
This approach only applies to items that are notated as “Provisional” in the contract BQ or the LOA
I list below a number of examples of the above for guidance of the team
EXAMPLES
A) RE-MEASURABLE CONTRACT
If Re-measurable the quantities in the BQ are the basis of the contract
The entire works should be re-measured and priced at BQ rates and the result replaces the quantities and price in the BQ
1. Tender drawings show item but item not in Bill, and construction drawings show same quantity with tender drawing without any changes.
Quantities shown on “for con” drawings are measured and priced – these replace quantities and rates in the BQ
2. Tender drawings didn’t show the item but Bills show some quantity. The construction drawings show different quantity to Bills.
Quantities shown on “for con” drawings are measured and priced ( in this case nil)– these replace quantities and rates in the BQ
3. Tender drawings show item but the item is not in construction drawings. Bills show the quantity.
Quantities shown on “for con” drawings are measured and priced ( in this case nil)– these replace quantities and rates in the BQ
4. Tender drawings show 10 nos but tender bill shows 12 nos. and the construction drawings show 10 nos.
Quantities shown on “for con” drawings are measured and priced ( in this case 10 nos)– these replace quantities and rates in the BQ
5. Tender drawings show 10 nos but tender bill shows 8 nos, and the construction drawings show 10 nos.
Quantities shown on “for con” drawings are measured and priced ( in this case 10 nos)– these replace quantities and rates in the BQ
6. Tender drawings show 10 nos but tender bill shows 8 nos, and the construction drawings show 7 nos.
Quantities shown on “for con” drawings are measured and priced ( in this case 7 nos)– these replace quantities and rates in the BQ
7. Tender drawings show 10 nos but tender bill shows 0 nos , and the construction drawings show 12 nos.
Quantities shown on “for con” drawings are measured and priced ( in this case 12 nos)– these replace quantities and rates in the BQ
B) LUMP SUM CONTRACT
If a Lump Sum contract the quantities in the BQ have no contractual significance and the contract sum is deemed to be based on drawings and specs
If there are changes the value of the works should be adjusted by measuring the only the difference between tender / contract drawings and the “For Con” drawings
1. Tender drawings show item but the item is not in Bill, and construction drawings show same quantity with tender drawing without any changes.
Quantities shown on “tender / contract ” drawings are the basis of the contract . If there is no change between “tender/contract” drawings and “for con” drawings then there is no variation or adjustment to the contract sum (regardless if there are any quantities in the BQ or not)
2. Tender drawings didn’t the show the item but Bills show some quantity. The construction drawings show different quantity to Bills.
Quantities shown on “tender / contract ” drawings are the basis of the contract . If there is a change between “tender/contract” drawings and “for con” drawings then that difference is a variation and adjustment to the contract sum is applicable (regardless of the quantities in the BQ)
3. Tender drawings show the item but the item is not in construction drawings. Bills show the quantity.
Quantities shown on “tender / contract ” drawings are the basis of the contract .In this case there is a change between “tender/contract” drawings and “for con” drawings (the work has been deleted) so the difference is a variation and adjustment to the contract sum is applicable (negative) (regardless of the quantities in the BQ)
4. Tender drawings show 10 nos but tender bill shows 12 nos. and the construction drawings show 10 nos.
Quantities shown on “tender / contract ” drawings are the basis of the contract . If this case there is no change between “tender/contract” drawings and “for con” drawings - So no adjustment to the contract sum is applicable (regardless of the quantities in the BQ)
5. Tender drawings show 10 nos but tender bill shows 8 nos, and the construction drawings show 10 nos.
Quantities shown on “tender / contract ” drawings are the basis of the contract . If this case there is no change between “tender/contract” drawings and “for con” drawings - So no adjustment to the contract sum is applicable (regardless of the quantities in the BQ)
6. Tender drawings show 10 nos but tender bill shows 8 nos, and the construction drawings show 7 nos.
Quantities shown on “tender / contract ” drawings are the basis of the contract .In this case there is a change between “tender/contract” drawings and “for con” drawings (the work has been reduced by 3 no) and that difference is a variation and adjustment to the contract sum is applicable (negative 3 nos) (regardless of the quantities in the BQ)
7. Tender drawings show 10 nos but tender bill shows 0 nos , and the construction drawings show 12 nos.
Quantities shown on “tender / contract ” drawings are the basis of the contract .In this case there is a change between “tender/contract” drawings and “for con” drawings (the work has been increased by 2 nos) and that difference is a variation and adjustment to the contract sum is applicable (additional 2 nos) (regardless of the quantities in the BQ)
C) LUMP SUM CONTRACT BUT PROVISIONAL QUANTITY (AS SRJ)
If the item or group of items in a Lump Sum Contract BQ or LOA are noted “Provisional” then those items (and only those items) should be treated as re-measurable (see Items A1-7 above)
